These Terms of Service govern access to and use of walletu, including the website, dashboard, public pages, digital cards, mobile wallet passes, and related features. By creating an account, subscribing to a plan, or using the service, you agree to these Terms and the Privacy Policy.
If you use walletu on behalf of a company or organization, you represent that you have authority to bind it to these Terms. In that case, “you” includes that company or organization.
1. Who may use walletu
You must be at least 18 years old and legally able to enter into a contract. Business accounts must be created and managed by owners, employees, or authorized representatives.
Participants may add a card issued by a business without creating a walletu account. The commercial relationship, the purchase that earns stamps, and delivery of the reward remain the responsibility of the business running the program.
2. Your walletu account
You agree to:
- provide truthful, current, and sufficient information;
- keep your contact email accessible and up to date;
- protect your password, email account, and authenticated devices;
- not share administrative credentials;
- immediately notify hi@walletu.app if you suspect unauthorized access;
- accept responsibility for actions by authorized users of your account.
We may require email verification, anti-abuse checks, or additional authentication. Google sign-in is also subject to the terms governing your Google Account. You may not register under a false identity or use another person’s details or brand without permission.
3. What walletu provides
walletu gives businesses tools to create and manage:
- loyalty cards, digital business cards, and other compatible digital passes;
- public pages with branding, bio, and links;
- codes and QR codes for enrollment and card identification;
- stamps, goals, rewards, redemptions, and operational history;
- notifications and updates allowed by the selected plan;
- view, click, and enrollment metrics;
- Apple Wallet and Google Wallet integration through technical providers.
Features, limits, and compatibility may vary by plan, device, country, and third-party service. The description and limits displayed in the dashboard or pricing page form part of the current offer.
4. The business is responsible for its program
walletu supplies the technology, but does not sell the business’s products, define its rewards, or become a party to the consumer relationship between a business and its customer.
The business is responsible for:
- setting clear rules, deadlines, eligibility conditions, restrictions, and rewards;
- honoring advertised offers and rewards;
- disclosing all relevant conditions before enrollment or purchase;
- correcting stamps or redemptions recorded incorrectly;
- supporting customers and resolving program complaints;
- following applicable consumer protection, promotions, advertising, tax, and professional rules;
- maintaining a lawful basis for participant data and communications;
- providing cancellation or objection mechanisms where required by law.
The business may not rely on a technical issue, plan change, or outage to deny a right already earned by a consumer. If the program closes, the business must notify participants and handle outstanding stamps and rewards under its rules and applicable law.
5. Participant data and privacy
For the business’s customer data, the business normally acts as controller and walletu as processor. The business must collect only data that is appropriate, necessary, and related to the program.
Unless walletu expressly authorizes it and a proper legal basis exists, you must not enter:
- health, biometric, racial or ethnic origin, religious belief, political opinion, trade union membership, sexual life, or other sensitive data;
- full identity document, payment card, bank account, or credential numbers;
- data about children or teenagers without meeting applicable legal requirements;
- purchased, unlawfully obtained, or undisclosed lists.
The business must respond to participant rights and cooperate with walletu when a request, audit, or incident concerns data under its responsibility.
6. Content and operational license
You retain rights in names, brands, images, text, rewards, links, and other content submitted to walletu. By submitting content, you grant walletu a non-exclusive, worldwide, royalty-free, limited license to host, copy, technically adapt, resize, transmit, and display it only as needed to operate, protect, and improve the service.
You represent that you have the necessary rights and permissions for your content. You must not submit material that infringes copyright, trademarks, image rights, privacy, or other third-party rights.
Public pages and cards may be viewed and shared by anyone with the link. Do not publish information that should remain confidential.
7. Acceptable use
You may not use walletu to:
- commit fraud, impersonation, phishing, money laundering, or another unlawful act;
- create deceptive promotions, nonexistent rewards, or abusive advertising;
- send spam, unlawful communications, or messages inconsistent with customer enrollment;
- harass, discriminate against, threaten, or exploit people;
- distribute malware, harmful code, or dangerous links;
- access accounts, cards, codes, systems, or data without authorization;
- bypass plan limits, rate limits, security controls, or billing mechanisms;
- copy, scrape, decompile, or reverse engineer the service except where the law grants a non-waivable right;
- overload the platform, test vulnerabilities without permission, or interfere with service operation;
- resell or sublicense the service as your own product without a written agreement;
- use walletu names, logos, or marks in a way that suggests a nonexistent partnership, sponsorship, or endorsement.
We may remove content, restrict features, or suspend access where there is reasonable evidence of a violation, risk to users, harm to the platform, or a legal duty. Where appropriate, we will try to explain the reason and allow a correction.
8. Apple Wallet, Google Wallet, and other services
Pass operation depends on third-party services, including Apple, Google, and the WalletWallet technical issuance provider. Social sign-in, anti-abuse protection, and email may depend on Google, Cloudflare, and Resend.
Those services have their own terms, policies, availability, and requirements. walletu does not control operating-system changes, device compatibility, store policies, notification delivery, or decisions made by those providers.
Apple and Google do not sponsor, administer, or assume responsibility for programs businesses create through walletu. A business must not use their marks or design elements outside applicable permissions and guidelines.
9. Plans, pricing, and payment
walletu may offer a free plan and paid plans with different limits for cards, participants, notifications, and customization.
- price, currency, frequency, known taxes, and renewal terms will be shown before purchase;
- no charge will be made without an authorization action by the payment-method holder;
- if checkout states that renewal is automatic, the plan renews until canceled, subject to mandatory legal rights;
- price changes will be communicated before affecting a future cycle where required;
- cancellation prevents future renewals, while paid access may continue through the end of a completed billing period;
- refunds and withdrawal rights follow mandatory law and the terms shown at purchase;
- taxes, withholding, and obligations on a business’s own sales and rewards remain the business’s responsibility.
If payment fails, we may restrict paid features after notice and a reasonable opportunity to resolve the issue. We will not immediately delete data because of one isolated payment failure.
10. Plan limits and plan changes
Each plan has limits displayed on the website or dashboard. When a limit is reached, we may prevent new cards, enrollments, or notifications until the next cycle, capacity is freed, or the plan changes.
When you downgrade, resources or content above the new limit may become unavailable. We will provide reasonable instructions for selecting what to keep where technically necessary. A downgrade does not remove the business’s duty to honor rewards already promised.
11. Availability, maintenance, and changes
We aim to keep the service secure and available, but do not promise uninterrupted operation. Maintenance, network failures, provider outages, Apple Wallet or Google Wallet changes, and events outside our control may occur.
We may change, add, or discontinue features to improve security, compliance, performance, or product viability. When a change materially reduces a current paid feature, we will try to give reasonable advance notice unless urgent security, legal, or third-party action prevents it.
Preview, beta, or test features may change or end and are offered without a commitment of future availability.
12. walletu intellectual property
The platform, software, design, documentation, walletu brand, components, and walletu-created content are protected by intellectual property laws. These Terms do not transfer those rights to you.
We grant you a limited, revocable, non-exclusive, non-transferable license to use the service while your account remains active and in accordance with these Terms. walletu may use feedback and suggestions without a payment obligation, provided it does not improperly disclose confidential information.
13. Suspension, termination, and deletion
You may stop using the service or request account closure at hi@walletu.app. We may verify your identity and ask you to resolve pending obligations before completion.
We may suspend or close an account if:
- there is a material or repeated breach of these Terms;
- use creates a fraud, security, third-party harm, or service interruption risk;
- a law or valid order requires action;
- authorized payments remain overdue after notice;
- the account remains abandoned for a prolonged period, after notice where possible.
Where safe and feasible, we will provide notice and an opportunity to remedy the issue. We may act immediately in serious cases.
After termination, public pages and cards may stop working. The business must plan participant communications and fulfillment of outstanding rewards before deleting data. Retention and deletion are governed by the Privacy Policy.
14. Confidentiality and security
Each party must protect confidential information received from the other and use it only for the service relationship. This obligation does not cover information that is public, already lawfully known, received from an authorized third party, or independently developed.
walletu uses proportionate security controls, but the business must also secure its accounts, devices, email, administrative QR codes, and internal permissions. No transmission or storage method eliminates every risk.
15. Warranties and liability
walletu will provide the service with care appropriate for a digital platform. However, to the extent permitted by law, the service is provided as available and may depend on third parties.
We do not guarantee that a program will increase sales, frequency, revenue, or retention. Results depend on the business’s offer, service, rules, promotion, and operation.
To the extent permitted by law, walletu is not liable for:
- rewards, products, services, acts, or omissions of a business;
- user content or rights violations caused by that content;
- misuse of credentials, codes, or devices under a user’s control;
- third-party failures or changes outside walletu’s reasonable control;
- lost profits, lost opportunities, or indirect damage that was not foreseeable.
Nothing in these Terms excludes liability that cannot legally be limited, mandatory consumer rights, fraud, gross negligence, or applicable data protection duties. Where a monetary cap is permitted, total liability connected with a paid plan is limited to the amount the user actually paid walletu in the 12 months before the event, unless the law requires a different limit.
16. Business indemnity
To the extent permitted by law, the business will defend and indemnify walletu against third-party claims arising from business-submitted content, the rules or rewards of its program, the business’s violation of law, or use of the platform in breach of these Terms. This obligation does not apply to the extent walletu caused the harm.
17. Governing law and disputes
These Terms are governed by the laws of the Federative Republic of Brazil, without displacing mandatory rules that apply to a user in their location.
Before starting a dispute, please contact us so we can attempt a direct solution. Nothing prevents access to consumer protection or data protection authorities or a court. In a consumer relationship, the legally competent forum, including the consumer’s home forum where applicable, will be respected.
18. Changes to these Terms
We may update these Terms to reflect changes in law, security, providers, or the service. The date at the top identifies the current version.
If a change is material, we may notify you through the website, dashboard, or email before it takes effect. Continued use after the effective date means acceptance where the law permits. If you disagree, you may stop using the service before the new version begins.
If a provision is invalid, the remaining provisions continue in effect. Failure to enforce a provision immediately is not a waiver. You may not assign these Terms without permission; walletu may assign them in a reorganization or business transfer while preserving applicable rights.
Translated versions are intended to convey the same content. If an interpretation differs, the Portuguese version prevails unless local law requires otherwise.
